Starting from November 7th, 2017, the Madrid Protocol will formally host its 99th member : Thailand, thereby underscoring the importance of this international system of trademark registration.
In force since April 1996, the Madrid Protocol is a treaty, administred by the International Bureau of the World Intellectuel Property Office (WIPO). It has been ratified by many countries and allows the protection of trademarks in 99 Member States.
The emergence of a need to centralize the demandes of international registration is part of the evolution of trade and globalization. In order to acquire a certain attractiveness, the Madrid Union has not ceased to evolve in order to conform to the specificities which may have emerged during the last century before founding the Madrid Protocol, and to which the international registration system for trademarks is largely based. Simplicity and economy are the decisive factors that have convinced 99 states to join.
Its expansion and success are due in particular to the simplicity of the application for registration. It is sufficient to file a single international application in a national or regional intellectual property office of a member of the Madrid system and to pay only one set of fees for filing in the designated countries.
Now, companies and trademark owners can easily register their trademarks in Thailand. This is an opportunity to rethink protection strategies, especially in Asia, in high potential countries such as Thailand, China, Cambodia and Vietnam.
