Takedown notice

Takedown notice

Definition

A takedown notice is a formal request sent to a host, registrar, platform or search engine to remove unlawful content: counterfeiting, brand impersonation, copyright infringement, phishing.

Legal framework

  • France: LCEN law of 2004
  • European Union: Digital Services Act (DSA), fully applicable since February 2024
  • United States: DMCA for copyright
  • Platform-specific procedures (Meta, X, Amazon, Shopify, etc.)

Elements of a strong notice

  • Clear identification of the rights holder
  • Proof of the right invoked (registration number, copyright)
  • Exact URL of the disputed content
  • Detailed description of the infringement
  • Sworn statement matching local requirements

Scaling

Exposed brands run takedowns by the hundreds per month. IP software or a dedicated IP solution helps industrialise the workflow.
